When Municipal Liability Matters

Active transportation comes with many risks that prevent many from making it their main way of moving around the city.


Our local government is responsible for providing us with public roads in good state of repair - repair is not only potholes, it’s the entire design of the roadway.

David Isaac, a personal injury law and avid biking activist, gave a talk at London Bicycle Cafe to educate people about their rights as cyclists, and some of the ways they can protect themselves.

“One of the best things you can do is up your car’s insurance personal injury protection” said David, “It will usually up your premium for about 5 or so dollars a month, and in return you can get 2M dollars in protection. If you get injured while biking you can use your car insurance benefits” 

If the bike lanes or routes the city provides injures you, you have 10 days to let the city know you are thinking of suing, and for pathways like the Thames Valley Pathway, they will only be liable if they act with reckless disregard of the safety of people using them. 

The first thing you should do if you ever get hit while biking is get off the road and call 911 if possible. 

  • Get the driver’s information, licence, insurance company and policy number. 

  • Record the coalition’s location and how it happened 

  • Jot down the contact information of your witnesses 

  • Take pictures of the collision including any damage to the bike or vehicle and any injuries.

  • Make sure to follow up with your family doctor or walk-in clinic even if you don’t need to go to the hospital.
